Privacy Policy
Smarty A.I., Inc. · Effective October 20, 2026
The short version. Smarty lets creators build an AI assistant (a "brain") from their own material and lets other people use it, sometimes for a monthly fee. To do that we store the material creators upload, the conversations people have with a brain, and a short profile of what a brain remembers about each person. A creator can see the conversations people have with their brain. We don't sell personal information, and we never share phone numbers or text-message consent with anyone for marketing.
1. Who we are
Smarty A.I., Inc. ("Smarty", "we", "us") operates smarty.ai, app.smarty.ai, trysmarty.com and the Smarty services, including text-message numbers run by Smarty (together, the "Service"). We are the data controller for the information described here. Contact us at hello@smarty.ai.
2. The people this policy covers
- Creators build brains from their own material and may sell access to them.
- Members and visitors use a creator's brain, by chatting on the web, by text message, or by opening pages the brain makes for them. Visitors use a brain without an account; members have an account and may pay the creator.
- Everyone who visits our websites.
3. What we collect
Information you give us
- Account details: name, email address, password (stored hashed), and sign-in details if you use a third-party sign-in such as Google.
- Creator material: documents, files, links and text a creator uploads to build a brain, the instructions and rules they write for it, and the pages the brain produces from that material.
- Conversations: the messages you send to a brain and the replies it gives, on the web or by text, including feedback you give on an answer.
- Memory: a short written profile a brain keeps of what you've told it that matters for future conversations (for example, a goal or a constraint you mentioned). You can see and delete it at any time, and you can tell the brain to stop remembering.
- Pages made for you: plans, checklists, calendars and similar pages a brain creates for you from its material and your conversations.
- Payment details: handled by Stripe. We store a Stripe customer identifier, the last four digits and brand of a saved card, and your billing history. We never see or store full card numbers.
- Phone number: if you text a Smarty number, your phone number and your messages.
- Ideas and feedback you post on our ideas board or send us.
Information we collect automatically
- Usage and device data: IP address, browser and device type, pages viewed, actions taken, timestamps, referring page, and diagnostic data such as error reports.
- Cookies and similar technologies: a session cookie to keep you signed in, a visitor cookie so a brain can keep your conversation together before you create an account, preference cookies, and analytics cookies. You can block cookies in your browser; some parts of the Service will not work without the session and visitor cookies.
- Session replay: we use PostHog to record how people use the app (clicks, scrolling, page changes) so we can fix problems. Text you type into inputs is masked in these recordings.
4. How we use information
- To run the Service: build brains, answer questions, remember what you've shared with a brain, make pages for you, deliver text messages, and send email a creator has asked a brain to send.
- To process payments, memberships, credits and refunds through Stripe, and to send receipts and billing notices.
- To show creators how their brain is used (see section 6).
- To keep the Service secure, prevent abuse, enforce limits, and meet legal obligations.
- To improve the Service, using usage data, feedback and error reports.
- To send service messages (account, security, billing). Marketing email is optional and every message has an unsubscribe link.
We do not use your conversations, uploaded material or memory to train our own or anyone else's AI models.
5. AI processing
Brains are built and answer using large language models from third-party providers, currently Anthropic and OpenAI. To do that, we send them the relevant creator material, your messages, and the brain's memory of you. These providers act as our service providers under agreements that prohibit them from using the data to train their models or for any purpose other than serving the request. AI-generated content can be wrong; see our Terms of Use.
6. What creators can see
When you use a creator's brain, that creator can see your conversations with it, what it remembers about you, the pages it has made for you, your membership status and billing history with them, and actions the brain took for you. They can also block you from their brain. Creators may not export or use this information for purposes unrelated to their brain. Smarty staff can access the same information to support creators and members, investigate abuse, and keep the Service running.
7. Text messaging
Some brains have a phone number. If you text one, we collect your phone number and the content of your messages so the brain can reply and so the creator can see the conversation. Messages are replies to the texts you send; frequency varies; message and data rates may apply. Reply STOP to any Smarty number to stop receiving messages and HELP for help.
Mobile phone numbers and text-message opt-in data and consent will not be shared with, or sold to, any third parties or affiliates for marketing or promotional purposes. All other categories of sharing described in this policy exclude text-messaging originator opt-in data and consent.
8. Who we share information with
We don't sell personal information. We share it only:
- With creators, as described in section 6.
- With service providers who process it for us under contract: Supabase (database, authentication and file storage), Railway (hosting), Anthropic and OpenAI (AI models), Stripe (payments and creator payouts), Resend (email), Twilio (text messaging), PostHog (analytics and session replay), Sentry (error monitoring), GitHub (code hosting).
- With people you ask us to share with, for example when a brain emails you a plan at the address you give it, or when you share a link.
- For legal reasons: to comply with law, a court order or a lawful request; to enforce our terms; or to protect the rights, safety or property of Smarty, our users or others.
- In a business transfer: if Smarty is involved in a merger, acquisition or sale of assets, with notice to you before your information becomes subject to a different policy.
9. How long we keep information
- Account details: while your account exists, then up to 30 days after deletion unless we must keep some for legal or billing reasons.
- Creator material and brain pages: until the creator deletes them or the brain.
- Conversations and pages made for you: until you or the creator delete them, or the brain is deleted.
- Memory: until you delete it or opt out; opting out stops new memory from being written.
- Billing records: as long as tax and accounting law requires.
- Usage data, logs and session replays: up to 12 months.
10. Your choices and rights
- See and delete memory: open "What this brain remembers about you" in any brain you use.
- Delete conversations from your chat list, or ask us.
- Leave a brain from your Account page; cancel a paid membership from Manage, which opens your Stripe billing page.
- Delete your account by emailing hello@smarty.ai. Creators' brains that others depend on will be handled as described in the Terms.
- Marketing email: unsubscribe link in every message.
- Text messages: reply STOP.
Depending on where you live you may have rights to access, correct, delete, port, or restrict the use of your personal information, to object to certain processing, to withdraw consent, and to complain to a supervisory authority. Residents of the EU, EEA, UK and Switzerland have these rights under the GDPR and UK GDPR. California residents have the right to know what we collect, to delete it, to correct it, to opt out of sale or sharing (we do none), and not to be discriminated against for exercising these rights. To exercise any right, email hello@smarty.ai; we may need to verify your identity, and we respond within the time the law allows.
11. International transfers
We are based in the United States and process information there. If you use the Service from elsewhere, your information is transferred to the United States. Where required, we rely on standard contractual clauses or other approved safeguards with our service providers.
12. Security
We protect information with encryption in transit and at rest, access controls, and monitoring, and we limit staff access to what their job needs. No method is perfectly secure; if we learn of a breach affecting you, we will notify you as the law requires.
13. Children
The Service is for adults. We do not knowingly collect information from anyone under 18. If you believe a child has given us information, email us and we will delete it.
14. Google user data
If you sign in with Google or connect a Google account to a brain, our use of information received from Google APIs follows the Google API Services User Data Policy, including its Limited Use requirements.
15. Changes
We will post changes here and update the effective date. For material changes we will email account holders or show a notice in the app before the change takes effect.
